While the legal case is pending, that might be true. But the States are given a good bit of power and lee-way. In contrast to some of the narratives out there.

The devil is in the details.
The legislation passed months ago sets the table for the rules which are determined by the administration in charge. Arkansas state legislators decided not to set up an Arkansas exchange so at least for now Arkansas will fall under the Federal exchanges.
A state exchange would give Arkansas more control however some felt that setting up a state exchange in Arkansas would be an endorsement and an aid to the advancement of Obama Care.
